In Belarus, those who are abroad can be tried
The law "On Amendments to the Criminal Procedure Code of the Republic of Belarus" has been published on the National Legal Internet Portal, according to which Belarusians who have left the country can be tried in absentia, CityDog.io writes. The law comes into force on July 26, 2022.
Special proceedings may be initiated against an accused citizen of Belarus who is abroad and evades appearing before the body that conducts the criminal process.
Articles of the Criminal Code under which special proceedings can be opened:
- Article 122. Preparation or conduct of an aggressive war.
- Article 123. Propaganda of war.
- Article 124. An act of terrorism against a representative of a foreign State or an international organization.
- Article 125. An attack on internationally protected institutions.
- Article 126. Акт международного терроризма.
- Article 127. Genocide.
- Article 128. Crimes against the security of humanity.
- Article 129. Production, accumulation or distribution of prohibited means of warfare.
- Article 130. Incitement of racial, national, religious or other social enmity or discord.
- Article 1301. Rehabilitation of Nazism.
- Article 1302. Denial of the genocide of the Belarusian people.
- Article 131. Ecocide.
- Article 132. Recruitment, training, financing and use of mercenaries.
- Article 133. Mercenary work.
- Article 134. The use of weapons of mass destruction.
- Article 135. Violation of the laws and customs of war.
- Article 136. Criminal violations of international humanitarian law during armed conflicts.
- Article 137. Inaction or giving a criminal order during an armed conflict.

In some cases, an absentee trial can be held in any article. Criminal prosecution authorities and courts should publish information on their websites about planned absentee trials – so that the accused can find out about them.
